IMĀM SHĀFIÝĪ: SAYYIDAH ÁĀYISHAH رضي الله عنها WAS A MINOR AT NIKĀĤ AND CONSUMMATION

Imām Abū Ábdillāh Muĥammad ibn Idrīs al-Shāfiýī [150-204 AH / 767-820 CE] states in Kitāb al-Umm:

“Abu Bakr married Áāyishah to RasūlAllāh ﷺ when she was a girl of six or seven,

and Nabī ﷺ consummated [the marriage] with her when she was a girl of nine, so the conditions in which the Nikāĥ and consummation took place was when Áāyishah was a minor; of those who have no control over her affairs. And more than one among the companions of RasūlAllāh ﷺ

performed the marriage of his minor daughter.”

From this we learn:

1. Sayyidah Áāyishah was six or seven at the time of Nikāĥ, not sixteen or seventeen.

2. Sayyidah Áāyishah was a minor who had no control over her affairs at both the time of Nikāĥ and consummation.

3. It was a common practice among the companions to perform the Nikāĥ of their minor daughters.

This refutes the claims of modernists and apologists who claim she was older and an adult woman. Even those who accept she was a minor at time of marriage,

they say that she had reached puberty at the time of consummation and that she had become a woman with mental maturity.

However, this shows that consummation with a minor wife is permissible when she is able to endure it, and neither puberty nor mental maturity are a condition.

So we ask you, O those who claim to be Muqallids of the 4 Madh’habs, and O those who claim to be followers of the Salaf, do you know better than Imām Shāfiýī? Do you accept his word or the word of a modern-day speaker who attempts to justify the actions of the Nabī ﷺ to Kuffār?

By Allāh, there is agreement of Ahl al-Sunnah, of the four Madh’habs that it is permissible to conduct Nikāh with a minor and consummate it when she is physically able according to most, neither puberty nor mental maturity is a condition for either of these two.

Thus, rectify your beliefs and save yourself from the misguidance and heresy of modern-day speakers and apologists.

May Allāh protect us from their Fitnah and allow us to be pleased with what was carried out and permitted by His Most Beloved, the Best of Creation ﷺ.

Before people accuse us of promoting this and having sexual interest in minors, then this is not the case. This is not an encouragement for anyone to do anything, nor is it because we wish to do so ourselves.

Rather, the only reason this is mentioned is due to the confusion in

our age regarding such issues, with numerous claims made by various people and groups. It is important that Muslims educate themselves well on these matters and thus save themselves and their families from confusion, doubts, and misguidance.
