Admin law asks narrow questions: did parliament clearly intend to give a power to limit rights? Did the Minister have a logical (not the best) basis for the decision? Such minimal requirements reflects a constitutional reality: politics matters so much more down here. By design
Next time you see some of us having conniptions over the next power grab that’s up in Parliament - care. Because right now a lot of Australians no doubt wish they could get back to 2015. Need a parliamentary culture driven by more than yowls and howls and question time brawls
Australia’s constitution bets on the politicians and parliament. It is not a constitution distrustful of government, the opposite. the law does not offer the protections the public often thinks it does and often plays an outsized role in public debate
