Also don't just keep following only me for your updates, bc in the middle of the day I gotta go get my Vax #2 -- so I'm gonna be gone for a good hour and a half or so, missing all kinds of juicy stuff. Three amazing colleagues are also putting the live blog together
Prosecution: The US & the defense are agreeing that the "interstate commerce element" part of the wire fraud and extortion charges are established and NOT in dispute. So if I understand correctly, the defense will not be arguing at any point that no interstate commerce occurred
First witness of the day: Sandi Lemanski again, IRS special agent
Lemanski examining JC's phone records from 2014-16
also Hildegar Camara's phone records from 2015-16, and Tony Costa's phone records from 2015-16, and David Brayton's phone records from 2015-19. Lemanski has before her a couple of MASSIVE binders that must be five inches thick each
7/14/16: Lemanski described a deposit of a $100K check from David Brayton to the account of Tony Costa. Then 7/14/16, a letter of opposition made out to Xiphias Wellness, Brayton's company
And then Brayton had phone contact with Hildegar Camara
She is using phone records to link Brayton, Camara, Costa and Correia together, essentially
Now Fall River Municipal Credit Union records from Correia's personal account from May-Nov 2016: $17,040 was put in this account in cash deposits. These deposits were not his mayoral paycheck, she testified -- cash deposits
so many binders!
Lemanski is swimming in binders rn
Records of purchases made by Correia for $1,983 worth of suits. Again 10/24/16, more suits worth $899.04, paid in cash and debit. Again 12/18/16, more mens clothing worth $3,197, paid in cash and card. 1/17/17: $694.78, again more men's clothes
from 9/16 to 1/17: Correia spent $12,514.78 in cash alone
that's about $3,100 spent in cash per month
12/14/17: Correia signs a letter indicating that Andrade would get a $10K snow stipend. Now we're looking at Andrade's employment agreement showing her annual salary: about $78K a year
Lemanski showed a series of bank records showing Andrade's direct deposits from her city job -- days later, or sometimes even the same day, Andrade wrote checks payable to Jasiel Correia for large amounts of money, which he then deposited
"So she gets paid, writes a check to Jasiel Correia?" "Correct."
During the period examined, she made 40K and change. She gave $22K to Jasiel Correia
Now they're detailing extravagant expenditures on a Mercedes Benz at Boch Toyota. No word if this occurred during Bochtoberfest
Lemanski said that searching campaign finance records, she discovered no records indicating donations to JC from Charles Saliby or anyone from the Saliby family
Lemanski further testified that in all her years of experience, she knows of no such technology to recover surveillance footage from cameras if the footage has been overwritten. "I've checked with people who know better than I"
This is a response to the defense's suggestion that cameras outside Saliby's store could've recovered footage of Correia outside the store -- the defense would seem to be insinuating that they could recover the footage but just won't. Lemanski has said that's impossible
Reddington asked if hundreds of thousands of dollars, or watches, were found in Correia's homes. Lemanski said no such searches were ever conducted
Reddington has very little else for Lemanski, and she steps down
"Your honor, the United States rests"
That means David Hebert and Gen Andrade are NOT testifying for the government
First witness for the defense, testifying via zoom: Jonathan Carreiro
I believe Carreiro is the twin brother of Christopher Carreiro, an attorney for Jasiel Correia
They're having some zoom muting issues. We can hear Carreiro but the courtroom cannot
They straighten out the issues. Carreiro is testifying at Logan Airport. He had plans to travel to Miami
Carreiro testified to some of the highly technical issues relative to fixing SnoOwl
So, uh, hey I'm back. Did I miss anything????
He WAT?
well, ok, the defense has rested and that's it for testimony, folks. Done. Much earlier than anticipated. Charging conference tomorrow, closings on Monday. I'm calling this thread here, if that's OK. Wow /end
