I am feeling so angry about Maratha reservation judgement. Supreme Court only had to decide whether Marathas should get reservations or not but it went one step further and has said that only central govt can identify which castes are OBCs henceforth.
This is totally unacceptable. It goes against federalism and totally undermines whatever small gains that OBCs have made in last few decades.
Remember that it was the states that gave reservations to OBCs right from India's independence. Where was central government then? Central govt trashed first backward class commission report in 1955. Second commission (Mandal Commission) was set up only in 1979.
Mandal Commission's recommendations were partially accepted in 1990 and its implementation started only in 1993. That's whole 46 years after independence. Then also OBCs got reservations ONLY IN JOBS.
OBCs had to wait till 2007, that is, whole 60 years after independence, to get reservations in higher educational institutions. Can OBCs trust the central government, which has been so careless about the rights of OBCs so far?
Central government hasn't given proportional reservations to OBCs but only half its population share. Compare that with 50% by Tamil Nadu. Other states too have tried to raise the quantum but courts shoot them down.
Central government has consistently refused to include OBCs in census enumeration. It refused in 2001, it refused in 2011 and it again is refusing in 2021.
State governments have been far more proactive when it comes to being responsive to the conditions of OBCs. They have included castes from non-Hindus in OBC lists without much fuss. Compare that with SC reservations. Only Hindus, Sikhs and Buddhists can be SCs.
States have sub-categorised OBCs right from the early decades of independence looking at the size of OBC population and internal diversity.
Centre lacks both motivation and expertise in responding to the issues of the OBCs.
OBCs must protest against Supreme Court judgment and so should state governments. It is ridiculous that all the state OBC lists, meticulously prepared over decades, are going to become redundant in one stroke.
