The UK EHRC have intervened in Forstater’s appeal saying that the employment tribunal’s December 2019 ruling was “wrong” and that gender critical views should be a protected belief under the Equality Act 2010.
“These are controversial views that we say should be protected,”
Their QC Karon Monaghan has stated she has gender critical views.

So I think it is clear that the EHRC are now throwing trans women under a bus.

Monaghan is also the QC for the High Court against the MOJ to ban trans women from women's prisons.
'Lawyers representing a woman, known only in court documents as FDJ, argue that male convicts who identify as female should not be imprisoned alongside women because they are ‘disproportionately’ likely to commit sexual assaults, and should instead be housed in a separate wing'.
'Her lawyer, Karon Monaghan QC, pointed out that while trans inmates made up just one per cent of those housed in women’s prisons “they are responsible for 5.6 per cent of sexual assaults”.'

Note that this is factually untrue.
This is an important case, because if they win then it can be replicated to all women's spaces.
