IANAL but I’ve read the appeals submissions.
Please feel free to provide a screenshot of exactly where in those submissions Ty went “Vic should not have been ruled a public figure because of reason X, and thus the actual malice standard should not apply.”

Because THAT's the sort of thing the appeals submissions needed to include to have any chance of success... and didn’t.
There are reasons why all the lawyers who predicted in June 2019, months before the hearing, predicted that the case would lose.
The same reasons, plus a whole set of brand new ones, are why the same lawyers are predicting that the appeal will be dismissed.

Getting back to one appeal as of right? Further appeals (to SCOTX) have to be applied for, and the general consensus is that that permission will be denied.
