Chief asks about strict scrutiny. AFP counsel says that's Thomas More's argument, but that policy fails under any standard of First Amendment scrutiny.
Chief asks an interesting question about the level of tailoring required under exacting scrutiny, saying it's not well-settled.
Thomas asks about groups that aren't controversial (groups that give beds to puppies). AFP counsel says you can't know which groups will become controversial.
Breyer is now asking how to distinguish campaign finance disclosure and tax reporting. (IJ's argues that campaign finance law is sui generis and shouldn't be expanded to other areas of the law.)
AFP answers in part that there's no statute here demanding schedule Bs, this is just bureaucratic whim. Similar answer for IRS
