Today in Baltimore Bail Reviews. Tweet thread from the notes.

Judge Jackson presiding, ASA Gregg Solomon has the bulk of the docket.
Case 1: A CDS case where it turned out what was recovered were not drugs. Case will be dismissed next week. All parties agree to ROR.
It should be noted that this loved one has been detained where there is COVID, limited soap, no cleaning products - for a non existent crime.
Case 2: A person tackled by cops after being seen doing a “security check”
ASA Solomon recommends HWOB

Case 3: A person held when a citizen’s complaint was made a month after an alleged interaction, no investigation done by the police. He has an underlying health issue that increases COVID complication risk.
ASA Solomon recommends HOWB

Case 4: A person with a lengthy addiction issue combined with severe mental health issues. All parties agree that treatment placement is best, but they need to placed on the box. All agree to home detention.
Case 5: A mother of 5 who is at risk of losing her housing due to incarceration. She has a mental health diagnosis and is not consistently receiving prescribed medications while detained.
ASA Salem recommends home detention

Case 6: A person arrested at the scene while the alleged victim was there. Victim was uncooperative with police and is uncooperative with the SAO office. Everyone agrees to ROR
Case 7: A person who has documented medical issues, including new issues since being detained that need special attention. There is also a need for ongoing, intensive inpatient treatment.
ASA Solomon says that there “appears” to be medical concerns, but there is drug treatment in the jail so no need to be released for that. Recommends HWOB
Judge Jackson orders ROR to the treatment facility.
Case 8: A young mother who was raised amidst addiction, who was introduced to drugs by the adults in her life at a very young age, had little protection or care throughout her whole life.
OPD has set up in patient treatment and ongoing support and services.
ASA Solomon recommends HWOB

Case 9: Involves a traffic stop ➡️smell of marijuana➡️search of car. Even Judge Jackson was seeing potential 4th amendment issues in the cops' story.

Some things included in the settlement:
separating positive residents from negative residents, quarantining exposed residents, weekly testing of residents and staff, heightened protections for high-risk residents. Most of this is not being done in MD DOC facilities.
Providing soap, masks upon request (not provided at most MD DOC facilities), 2x daily medical check for medically vulnerable loved ones; vaccinations and education about vaccinations to all residents by May 1.
(yes, it took a lawsuit, these things don't regularly happen at MD DOC facilities)
It is pointed out that these changes have (weirdly) dramatically decreased COVID in the Chesapeake detention facility.
The loved one in this case has serious medical issues that place him on the chronic care list for JCI. He is asking to be moved from JCI to the Chesapeake facility.
A federal public defender is on the call to explain, in great detail, all options and contingencies, for the Baltimore SAO to continue their prosecution of this person while he is in federal custody.
ASA Raiven Taylor agrees to the transfer.
Judge Jackson so orders.
Case 12: A person with severe medical issues. They have acquired 150 pages of medical documents just during pretrial detainment. They are detained because cops see marijuana in a car, this person has a medical marijuana card.
ASA reccds HWOB

Case 13: A traffic stop for failure to use turn signal. Cops search without any reason, do not even try to present "smell of marijuana" as a reason.

Case 14: An older gentleman who has been placed on medical isolation 4 times since arrest due to exposure to COVID.

Case 15: A father who has a newborn & a medical issue that is deteriorating while he has detained. This stems from cops seeing a car run stop signs. Find the car later, parked, no one in it, they arrest someone on the street nearby.

Case 16: A young father who has been detained since May of 2020 with no realistic trial date in sight.

Case 17: A person on the DOC's own medically vulnerable list who is being held in a facility with active COVID cases.
All parties agree to ROR with supervision.
Case 18: Reset due to the defense attorney not be present.
That is the end of the docket. Enjoy your weekend. Wear your mask, get vaccinated. Take of your self and others. Do not call the police.
