I’m not interested in the legal theory behind his claims - I’d rather discuss his motivations. Because, with Kennedy-Shaffer, there’s always an agenda and that is to make a name for himself. To get into politics.
Alan’s goal is making a name for himself. His employer, in 2013:

Speaking of his military service, this is why he does it. For the campaign photo. He takes a high profile case or 2 on the side (he’s mainly a professional student), but it’s for name recognition - his goal is politics.
Using his military service for op-eds and clout would be less offensive if he didn’t LIE about his service.
