For the acres of policy reports recognising market power harm from #data & #privacy_failures, the record isn't good. Antitrust experts - esp. classically trained IO economists in agencies - dont talk to privacy experts. "We do market power here, not privacy". 2/
But #data_protection regulation in Europe has failed to enforce existing laws. So, "competition agencies are left to pick up the pieces", says @CMAgovUK CEO. Yes, but also need to "adopt a holistic approach with privacy regulators" - see , 30' into 3/
A major problem is the way we think about #information in classical models ( #more_data is good, generates efficiencies) is the wrong posture. Canonical models don't cover privacy, economists "stay in their lane". Yet #misuse of personal data is becoming ever more harmful. 4/
Two ways to update
1. (Lack of) privacy is a #price (often unobservable) of using digital platforms. We need to think of it as such.
2. (Lack of) privacy & data protection facilitate mainstream antitrust harms ( #exploitation, #foreclosure) in ways we must explicitly formulate 5/
Antitrust agencies also need to ask: for each #processing_purpose how is the data obtained? Has #consent been sought transparently and fairly? How is the data going to be used, is it observable, and what #value do consumers place on it? 6/
Can a deal/conduct create greater scope for #discrimination & #extraction of surplus? For #leveraging personal data into new (and possibly tied) markets or services, or create conflicts of interest? What remedies would prevent the #internal #free_for_all? #Purpose_limitation? 7/
Much to do but need the antitrust bubble to learn from the #privacy experts. #Integration, not just interface or intersection...
