On the other hand, the victim comes from a poor and uneducated family ignorant of legal issues that are a common phenomenon in Pakistan. Those who are lecturing an unaware low-income family to show solid proof should know that its police job to collect evidence from acrime scene
The poor rape victims have nothing to prove they were subjected to rape, but they have to survive with trauma. FC denies the allegations but said the force had launched an inquiry. The medical report says officials found no torture marks or signs of rape.
The question is, why a family referred a mentally sound and healthy boy to a hospital? What is the reason FC investigates a sepoy on false allegations? What forced an entire town to protest under scorching heat? Why it took more than 24-hours for the hospital to reveal a report?
The family may later change its statement under pressure. Still, they were saying till yesterday, police didn't register an FIR against FC, and the medical staff at Turbat Teaching Hospital even didn't examine the victims when they named FC.
If a court later decides a rape didn't happen due to lack of evidence, that doesn't mean a rape had never happened. This is a fundamental flaw in the criminal justice system. Besides that, it is a fight between a powerful institution and a lower-middle-class family.
One party is clearly capable of tampering with evidence and pressuring the hospital to prepare a report of its choice and will. The other one is weak and totally ignorant of legal issues. Under such circumstances, don't expect a hospital to produce a report based on facts. End
