HMT/HMRC should then assess whether its a real barrier.. whether the costs of action (lost revenue etc) are outweighed by the benefits of it, and make a recommendation to the Chancellor .. who should take a decision on the basis of that assessment
even better - that assessment should accompany the measure (spoiler most tax policy decisions are not accompanied by much evidence..) - but ministers should avoid at all costs the suggestion they are "fixing" the tax system for a particular taxpayer..
esp if they are caught by the rules because they have chosen to offshore production/minimise UK tax liabilities...
