So the High Court will deliver judgments in not one, not two, but three @RightToKnowIE cases this week.

Judgments by Simons, Barr and Barrett respectively, all focussed in different ways on the AIE Directive/Regulations

Update: In Right To Know CLG v OCEI (and RTÉ) Judge Max Barrett has found (comprehensively) in our favour. The OCEI must do decision again in light of the judgment.

Here's the court's summary of the issues that were at hand.

Update: the Barr judgment in Right to Know CLG -v- Commissioner for Environmental Information; the Minister for Communications, Climate Action and the Environment; Ireland and the Attorney general and the Office of the Secretary General to the President of Ireland, is out.

The third judgment is out, this time Judge Simons in Right To Know CLG v An Taoiseach. Judge Simons is referring the case to the Court of Justice of the European Union.

The case hinges on the following question:

When the Cabinet (or a Cabinet subcommittee) meets: does it amount to "internal communications" of a public authority or "proceedings"?

The distinction is important and now the court in Luxembourg will need to decide.

A second question arose during the case around res judicata, which will also form a question to the CJEU

What is Right To Know seeking? Information on Cabinet discussions of climate change. Pretty, eh, important. R2K is now 5 years into this question.
