Judge Bates found there's no evidence Klein planned to be violent, coordinated with others or was a leader on Jan. 6.

"Klein’s conduct was forceful, relentless, and defiant, but his confrontations with law enforcement were considerably less violent than many others that day"
Judge also says Klein's participation on Jan. 6 "constitutes a substantial and deeply concerning breach of trust" and he might be "highly culpable for his conduct." But he says that it's not clear how Klein's old job makes him a future threat to the community.
