A poll: the House votes TODAY on SB 5062, the Bad Washington Privacy Act!
Industry supports @ReuvenCarlyle's Bad #WPA
Almost nobody likes @RepDrewHansen's CRJ striker
Immigrant rights, civil liberties, privacy groups support @RepKloba's amendments
What will happen? #waleg

And if you want #RealPrivacy4WA, contact your reps as soon as possible and ask them to support the Kloba amendments -- and vote no on the bill if the amendments don't pass. http://bit.ly/5062SupportKloba
Some background: SB 5062 is @ReuvenCarlyle third try at a bad privacy bill
In 2019 and 2020, the Senate passed abad bill overwhelmingly, the House did a lot of work to improve it and pass something much better, the Senate refused to compromise, and nothing passed. #waleg

@ReuvenCarlyle represents Amazon's district, and has good relationships with big tech lobbyists.
So he ignored the House improvements and feedback from civil liberties, immigrant rights, and privacy groups, and proposed another bad bill.
So he ignored the House improvements and feedback from civil liberties, immigrant rights, and privacy groups, and proposed another bad bill.
But the Tech Equity Coalition -- a group of civil liberties and civil rights-focused organizations and individuals working to hold technology accountable -- worked with @ACLU_WA and @RepKloba to introduce a GOOD bill, the People's Privacy Act https://www.seattletimes.com/opinion/washington-needs-a-privacy-law-that-protects-people-not-corporations/
SB 5062, @ReuvenCarlyle's Bad Washington Privacy Act, got a lot of criticism in its Senate hearing. Here's Susan Grant of @ConsumerFed talking about the "loopholes and definitional problems that neuter enforcement". https://vimeo.com/534177168
@BAuffrayEsq of @cair_wa talked about how SB 5062's out-out framework did not protect Muslim americans, who continue to be targeted by surveillance.

I've got a round up of testimony at https://jedii.tech/criticism-and-praise-for-at-the-hearing-for-sb-5062-the-bad-washington-privacy-act/
But, @Reuvencarlyle's the chair of the Senate committee. So they advanced the bad bill without any significant changes.

The Bad Washington Privacy Act sailed through the Senate, passing 47-1, with only @bhasegawa voting no.
Meanwhile, @RepDrewHansen refused to hold a hearing for People's Privacy Act in the House.

So the Tech Equity Coalition and other privacy advocates lined up to testify against SB 5062 in the House Civil Rights and Judiciary Committee hearing. Here's my live tweeting. https://twitter.com/jdp23/status/1372239685964034048
Tech lobbyists talked about the "consensus" supporting the Bad #WPA with its "strong protections".
@ashdelv of @ResistenciaNW disagreed: "This bill leaves immigrants vulnerable to data exploitation." https://vimeo.com/532382735

@elijsanders has some great coverage
As @ashdelv says “You only need to look at the list of those signed in as ‘pro’ versus ‘con’ to see that tech companies, not people, are in favor of this bill,” https://wildwest.substack.com/p/inside-one-states-fierce-battle-over

I was going to highlight the inconsistency between these views and the lobbyists talk of "consensus" and "strong protection" and suggest an explanation: the lobbyists are lying.
But I didn't get a chance to speak.
But I didn't get a chance to speak.
@RepDrewHansen shut down public testimony after half an hour. So many people had signed up to testify against the Bad #WPA that most of us didn't get to speak -- including people like @ashk4n, Susan Grant, and 8 Indivsible activists.
After the hearing, the CRJ committee made some minor improvements in an amendment, enough to get the support of @ConsumerReports and @CommonSense
It passed on a strict party-line vote -- another nail in the coffin for the myth of "consensus".

But nobody else likes the CRJ amendment.
Industry says its too strong
Immigrant rights, civil rights, civil liberties groups said it still doesn't protect our privacy. Indivisibles agree.

Up next: the Appropriations hearing on the Bad Washington Privacy Act. Here's my livetweeting https://twitter.com/jdp23/status/1377652845835558915
This time I *did* get to speak, using air quotes to highlight my suggestions that they take lobbyists talk of "lack of public input", "hardship" "robust enforcement", "sensible compromise" with a grain of salt. https://twitter.com/joejerome/status/1377668404555943942
Once again @elijsanders has great coverage.

Appropriations advanced the Bad Washington Privacy Act without any amendments, again on a party-line vote.

But then, an unexpected twist! @RepKloba submitted a striking amendment -- completely replacing the current text of SB 5062, and addressing the problems Tech Equity Coalition and grassroots groups have been focusing on! …https://signon-acluofwashington.nationbuilder.com/support_kloba_amendment_to_sb_5062
And there are lots of other SB 5062 amendments as well. 22 in fact!
Here's the letter @IndiPlusWA and other Indivisble groups sent the House, asking reps to SUPPORT @RepKloba's amendments, and OPPOSE the bill unless the amendments pass.

There's been a lot of great writing this week on problems with the Bad #WPA
@Scatterbrandy on @DemCastUSA: "SB 5062 as is purports to provide a measure of data privacy without actually doing so" https://demcastusa.com/2021/04/10/real-electronic-data-protection-is-opt-in/

"The legislation goes too far in pandering to the demands of technology corporations and not far enough in protecting the privacy of everyday people, including immigrants and refugees." https://iexaminer.org/interims-corner-the-washington-privacy-act-insufficient-for-the-immigrant-refugee-communities-we-serve/

@hellrazr on the Bad Washington Privacy Act:
"It protects tech industry’s rights, but leaves the privacy rights of the people almost completely unprotected.
The bill is a "full-on Monet." https://jedii.tech/the-bad-washington-privacy-act-an-illusion-of-rights-and-as-cher-would-say-what-a-monet/

The House is still on break in caucus. Oh to be a fly on the wall!
It's a tough situation for Washington Democrats. They know the Bad #WPA is unpopular. Do they push it through anyhow? Do they take a chance and support @RepKloba's amendment? Or just let it die?

@joejerome's got a very good thread looking at the floor amendments. There really are a lot of them! https://twitter.com/joejerome/status/1380935161538355200
And, here's the correct link to @BAuffrayEsq's testimony about how the Bad Washington Privacy Act fails to protect Muslims and other groups who are targeted for surveillance - I mentioned this earlier in the thread but botched the link. https://vimeo.com/532382773
Here's the TVW link to this afternoon's House session -- it still says "Coming up next" so I'm not sure if they're in caucus or on the floor but not streaming yet.

And they're live on the House floor! Still not sure whether they're going to consider SB 5062. Right now, they're discussing SB 5460 on Autonomous Vehicles.
