The #ABCTest isn't totally new; it streamlines existing law: when courts look at each part, or "prong," of the test, they look for a "preponderance of evidence" from existing tests to make a decision. These are called "secondary factors" and come from the #IRSTest or common law
So when people say #IRSnotABC, they may not realize that ABC is already IRS to a very wide degree. The "B" prong is the strongest part of the law to provide rights and protections on the job, and prevent #misclassification. In the PRO Act, no exemption is needed or helpful
