*Thread* Biden wants the ATF to treat brace-equipped pistols as SBRs subject to the NFA. That's a terrible idea. I have spent an inordinate amount of time researching this topic, and I'm going to share everything I've recently written on it in the tweets below.
To start, let's go back to the beginning: @MattLaAtLaw and I explain that the SBR rules that Biden refers to are essentially "accidental law"--vestigial remains from a *first draft* of the NFA that make no sense in the context of the *enacted law*: https://www.washingtonexaminer.com/opinion/the-atfs-obsession-with-pistol-braces-is-based-on-accidental-law
In "Felony by Fiat," I discuss at length how the ATF's barrel-length rules function in practice. The short version? These rules turn unwitting and peaceful people into felons, but don't actually provide public safety value. #FelonyPuns https://marklivesthings.medium.com/felony-by-fiat-the-absurd-and-arbitrary-regulation-of-short-barreled-firearms-in-the-u-s-f7ad36043213
In this @feeonline piece, I expand on that topic with particular reference to the Honey Badger situation--a striking example of exactly the sort of arbitrary ATF rule-making and enforcement action that I warned about in "Felony by Fiat": https://fee.org/articles/how-the-atf-has-become-a-rogue-agency-that-turns-lawful-gun-owners-into-felons
Time for a bit of comic relief: the ATF accidentally admitted that the firearms in question here don't inherently constitute a special public safety concern. Whoops!

And late last year, the ATF sought to do something similar to what Biden's telling them to do now. The agency issued a notice w/"proposed guidance" that was, to put it politely...trash. The notice was withdrawn. Here's my comment on that document: https://marklivesthings.medium.com/regulatory-comment-objective-factors-for-classifying-weapons-with-stabilizing-braces-2b1bfc4bb3b4
Looks like I'm going to have to rehash all of this stuff over the next few weeks. I'd prefer to spend my time lifting weights and shooting guns, but here we are
