We can’t obey the ruler even if he flogs our back and takes our wealth?

Here we see no mention of flogging back and tacking wealth, if we look at the chain of narrators for this one, Hudhayfa bin Ya’mal narrated it from Abaa Idrees al Khawlaani

In the hadith where it mentions flogging back and taking wealth. we see there is a narrator called Abi Salaam.

Shaykh Muqbils website, May Allah have mercy on him, he says this hadith is on the authority of Abi Salaam Mamtoor al Habashee and he did not listen to this from Hudhayfah, this is from the hadith that has been criticised by al Daraqutni and this hadith of Hudhayfah. (4/37)
Which has been agreed upon and known in the Saheehayn, the wording (even if flogs your back and takes your wealth) is not in the original Hadith. This is narrated in two paths, one in Sunan Abi Dawud, (5/37)
and another in Sahih abi Awanah and the apparent is that this does not raise the hadith to hasan, and is not used as evidence, and Allah knows best.

Let’s see what al Daraqutni said, May Allah have mercy on him

He said,”This hadith is mursal(this is interrupted, Abu Salaam did not hear this from Hudhayfah nor his colleagues who landed in ‘Iraq, because Hudhayfah bin Ya’mal died one night after the killing of Uthman.

And in it, it contains ‘Hudhayfah said’, so this indicates that it is mursal.

The first one I mentioned, from the chain of narration is authentic, from Aba Idrees al Khawlani. The second one is Mursal.

The issue is that Mamtoor al Habashi is from Damascus and (8/37)
Hudhayfah was in al Iraq, and the ulama have agreed that Abu Salaam did not hear this from Hudhayfah, he heard it from someone in Syria, the wording,”even if he flogs your back and takes your wealth” is an insertion. It was not stated by the Prophet ﷺ

This is from a website of Syrian scholars, they comment on this hadith too. They said the hadith is munqati’a, meaning disconnected, from Abu Salaam, the Syrian, the Damascan, and Hudhayfah.

In the first arrow they confirm what I said above about Daraqutni. (10/37)
At the second arrow, it says it’s disconnected and the sanad from this path/authority is inauthentic.

Now Imam al Nawawi argues that because the first hadith is authentic and the second one follows on, so they both should be accepted.

But Imam al Nawawi argues his point.

I’m going to go to Abu Fahad al ‘Ajami, the kuwaiti scholar, he looks through different chains of the hadith and he’s going to comment on them(12/37)
1)He said that 8 people narrated this from Hudhayfah,and is agreed upon in the two authentic sources and other than it without the increase

2)He said that this hadith was narrated by safr al azdi,but this also does not have the increase,narrated by Imam Ahmad in his musnad

The third one, narrated from Hudhayfah, the person who did it was Zayd bin wahab, and it also doesn’t have this ziyaadah(increase, meaning,”even if he flogs your back and takes your wealth”)

The fourth one, narrated from Hudhayfah, and the other person is Mak’hool.

Number 7 is from Abu Salaam, and number 8 I will get to إن شاء الله

The other hadith I bring which will states,”They will follow a sunnah other than my sunnah.” Does not say to obey the ruler. In fact it says otherwise.

and he asked ”who are the foolish leaders?”

He ﷺ said, ‘there will be leaders after me who don’t follow my guidance, and they will not follow my sunnah”

Notice that phrase came again? This was heard in the hadith by Abu Salaam, but we know the phrase,”even if he flogs your back and takes your wealth” is disconnected

The Prophet ﷺ advised

“Whoever believes in their lies and AIDS THEM IN THEIR OPPRESSION, they are not from me, and I am not from them and they will not come to me at the hawdh (pool of water in judgement day the people who follow the SUNNAH will drink to quench their thirst)

Our prophet ﷺ did not endorse oppression

This hadith is strengthened in Jami’ al Tirmidhi,

1)The first path of this hadith, the chain of transmission and the text is narrated in the saheehayn from Abu Muslim al Khawlaani from Hudhayfah radiyallahu anhu, is more authentic.

2)The second one which is narrated

3)The statement even if the ruler flogs your back and takes your wealth is inauthentic for Hudhayfah

Abu Fahad has shown the 6 pathways without the addition

The 7th from Abu Salaam which has the inauthentic addition, it’s mursal. If you say the matn is saheeh, so the Prophet ﷺ didn’t say but the matn is saheeh, this hadith will prove it’s only in lawful matters
