Right. I need to see the decision, but the reason it landed with Nicol is because Schillings must've lodged notice on the day of handing down. There are two ways to lodge permission to the court in question: 1. During judgment notice period, 2. On handing down.
The notice period was the seven days prior. If you lodge then, judge will say in the judgment if refused or granted. So, this indicates how surprised Depp's lawyers were. They then wait for hand down, and ask then. They then have 21 days. So lodged Monday which is correct.
There's NO way to predict which court appeal is sought from because orders of this kind are not public. Nicol then received, reviewed, decided. No hearing, no notice of decision (yet). Depp has seven days to go to the CoA. Going back to Nicol suggests they are grounds of law.
