Medicaid is not safe, neither is the ACA.

On November 10th, the US Supreme Court will hear California v. Texas, in which Trump's DOJ and a coalition of GOP state officials, will argue the entire ACA must be struck down.

Democrats have not taken the Senate. 1/
Winning the White House is necessary to ensure the survival of the ACA, but isn't enough.

I don't know what the Supreme Court will do about the GOP's ACA lawsuit. But IF the Court harms the ACA + we need a new bill to fix it, that will require the cooperation of Congress. 2/
It is very difficult, impossible really, for me to believe that Mitch McConnell's Senate would cooperate in an effort to save (or restore, if you'd like) the ACA.

Control of the Senate seems to me to be critical to guaranteeing the survival of the ACA. /3
"What will the Court do?" is a good question.

Here's the truth: I do not know what the Supreme Court will do and anyone who tells you that they :know: what the Court is going to do is lying to you. 4/ https://twitter.com/davastewart/status/1324743434675126277?s=20
'Does a President Biden help at all?'

It's possible that having President Biden helps, yes. There are some potential outcomes to the lawsuit for which having a POTUS committed to saving the ACA will make the difference 5/ https://twitter.com/AbleismCancel/status/1324741039857565696
What I hope you to take away from this thread is that (as certain as some legal commentators may be about what they think the Court will do) we do not actually know how the Supreme Court will rule on the ACA case

I'm covered by Medicaid-expansion. I wish we did know. 6/
It may be that the Supreme Court quickly rejects the GOP's argument that the entire ACA must be struck down. If that day comes and you're angry at me for this thread?

Honestly, I'll take it – because we'll both be alive. /7
(Generally, when at least a couple of folks reach out privately with the same question, I assume it's a question on lots of people's minds. This morning, a couple of very sophisticated people reached out privately to ask if the ACA was now safe. Hence this thread.)
(Especially when those folks are, themselves, at risk, or their kids are at risk, I try to address the question publicly if I think I have something useful to say.

We have a fighting chance – I promise we'll keep fighting. /fin https://twitter.com/mattbc/status/1324561174185193472?s=20
