THREAD: @DHSgov and @USCIS will publish the official South Sudan #TPS decision Monday in the Federal Register, the SAME DAY that TPS and work permits expire. This is incredibly harmful to people in normal times, let alone #COVID19.
The consequences of delayed notices, compounded with @USCIS historic backlogs makes it impossible for #TPS holders to get the documents they need when they need them. It costs people income, jobs, drivers licenses, and more at absolutely no fault of their own.
Prior to this administration, TPS decisions were typically published 60 days before the end of the designation period, across Democratic and Republic administrations. 60 days is the correct interpretation of the law, ensuring people have time to re-register and talk to employers.
This administration has made 17 TPS decisions. 4 were published 10 - 30 days late. 9 were published 30 - 50 days late. 5 decisions, including the past 3 in a row, have been published more than 50 days late, giving TPS holders literally only days before current documents expire.
In the South Sudan Notice, @USCIS writes “It is important for re-registrants to timely re-register during this 60-day period and not to wait until their EADs expire” even though their work permits expire the day @DHSgov and @USCIS publish the Notice. Absurd!
@USCIS also elected not to give South Sudanese TPS holders a longer automatic extension of their work permits or a longer re-registration period under #COVID19, despite the circumstances and their own failures to provide the impacted community with timely essential information.
Congress MUST hold @DHSgov and @USCIS accountable for #TPS Federal Register Notices delays and other issues during the implementation of #TPS decisions at @USCIS. These issues have SERIOUS consequences on people’s abilities to live their lives and care for their families.
