Now do North Carolina
Alito, writing for Thomas and Gorsuch, reluctantly agreed with the rest of the justices not to expedite consideration the PA case: https://www.supremecourt.gov/opinions/20pdf/20-542_i3dj.pdf
But but but Alito, Thomas, Gorsuch end by saying HEY YO REPUBLICANS IF YOU COME TO US AFTER ELECTION DAY ASKING US TO THROW OUT THE BALLOTS BEFORE THEY'RE COUNTED, WE WILL TOTALLY VOTE FOR THAT
Alito, Thomas, Gorsuch pretty much leaving themselves an out here: by not taking up the case, they are giving PA GOP the option to withdraw its petition should Trump actually want mail-ins to be counted after 11/3 https://twitter.com/MikeSacksEsq/status/1321525837733265409?s=20
Meanwhile Kavanaugh's silence here means either he's embarrassed by his error-riddled WI opinion the other day and is slinking away a la that time he voted to kill a Muslim guy without an imam but voted to save a similarly-situated Buddhist weeks later, or....
Perhaps Kavanaugh is an orthodox adherent to the age-old "too-close-to-the-election-to-rule-how-my-party-wants-if-we-just-refused-to-do-it-last-week rule."
SCOTUS says "Additional opinions may follow," so maybe Kavanaugh will explain himself after all, like he did when he refused to kill the Buddhist death row inmate without a cleric present after green-lighting the execution of a similarly-situated Muslim
Roberts's silence in this case is a new data point to suggest that maybe he never anticipated his legislature-means-legislature principle could be used to nullify a state supreme court's interpretation of state law, and sincerely thought Rehnquist's Bush v. Gore opinion was dead
The NC GOP's stay application will present Roberts with another opportunity to weigh in before perhaps having to go on the record with where he stands in any case that may come after Election Day https://twitter.com/MikeSacksEsq/status/1319345565453303808?s=20
