Meanwhile Kavanaugh's silence here means either he's embarrassed by his error-riddled WI opinion the other day and is slinking away a la that time he voted to kill a Muslim guy without an imam but voted to save a similarly-situated Buddhist weeks later, or....
Perhaps Kavanaugh is an orthodox adherent to the age-old "too-close-to-the-election-to-rule-how-my-party-wants-if-we-just-refused-to-do-it-last-week rule."

Roberts's silence in this case is a new data point to suggest that maybe he never anticipated his legislature-means-legislature principle could be used to nullify a state supreme court's interpretation of state law, and sincerely thought Rehnquist's Bush v. Gore opinion was dead
