Thread on the outcomes of new Land Law of JK UT

1. JK UT has been divided into 3 types of lands- Agricultural, Forest, Nazul or commercial land.
2. No domicile is required for the sale of any of the above 3 types of land. Anyone can now buy the land.
3. Agriculture land however can be sold to anyone provided that land is used for only educational or healthcare setups. This transfer or categorization can now be easily done by the Tehsildar.
4. Non agricultural or Nazul land can be sold to any one from outside JK. No domicile or state subject or PRC would be required. Only Adhar would be sufficient.
5. Forest Land would be reserved under Forest Department of JK, however Indian Army can use special clause 2A of AFSPA to declare any forested land as a strategic land. Army can then use land for any purpose and even sell to private partners on lease.This is most powerful clause.
6. Army can also declare any land and use it for setting Industrial Corporations.
Second order issued has implemented RERA(Real estate Regulation Act) too on JK and now come under the ambit of Central government preventing any further state sponsored muslim settlement.
7. most important- Big Land estates Act passed by JK constitution on 1961 stands abolished. The maximum ceiling of 1/3 stands abolished. The act had made all the wealthy hindus of kashmir landless, distributing lands to tillers. The act now stands abolished.
8. Roshni Act and Tribal land transfer Act stand abolished. No pastoral land can be transferred to muslim gujjar tribals now who previously used to grab lands on the pretext of grazing livestock. UT is now empowered to take back grabbed lands.
9. Most important. Slum Dwellers Act has been modified. Now any slum dweller who has been living in JK before 2010 can now be a domicile of JK and is entitled to PM Awas Yojna. The UT is now empowered to transfer land to setup Residential quarters for slum dwellers from outside.
10. Prohibition of conversion of Orchard Land Act 1975 JK constitution stands abolished. Any orchard land which previously was under political leadership and whose transfer was an offence can now be transferred and sold to anyone from outside.
11. In a nutshell the Centre has enacted Domicile law of 15 yr cutoff to safeguard govt jobs and state schemes for local natives while opening JK land to everyone. It has also made a minor safeguard for agriculture land. However the land laws of Himachal are more strict than this
12. Districts with highest agriculture land are - Kathua, Samba, Jammu, Udhampur, Kashmir valley.
Districts with highest forest- Doda, Kishtwar, Reasi, Ramban, Poonch, Rajauri, Udhampur, Kathua, Anantnag, Baramulla, Bandipora, Kupwara.
