States are gearing up to push laws that would criminalize health care for trans youth and anti-trans advocates are arguing that cis people have a constitutional right not to share space with trans people. So, what does this mean and what can we do?
Paying attention to state and local elections and state lawmaking is critical. The escalation of anti-trans policy is dire and with the courts as they are it will be very difficult to successfully challenge these horrible bills in court.
Some things that will help: voting anti-trans state lawmakers out of office (i.e., flip the Texas House); organize and lobby against these bills, give $ to trans people for health care, protect the ACA and advocate for Medicare for all; get rid of Trump and the GOP Senate.
This is truly life or death. If we cut off all care to trans youth, people will die. Likewise, if SCOTUS affirms a right in the Constitution for cis people not to share space with trans people, it will mean no state, local or federal protections for us in single-sex spaces
We will not be able to undo it in Congress. States and schools and cities won’t be able to legislate around it. We would have to overturn it in the Supreme Court (or pass a Constitutional Amendment). No more NYC trans policies, no more local protections.
The Supreme Court could come in and constitutionalize the TERF created notion that our existence is a threat to others. The very justices who don’t believe in a right to privacy for abortion are poised to locate such a right to banish trans people from society.
We have to fully start over and we need the space to do it. We need to change the judiciary. We need to stop the momentum that Trump has built because we need more space & time to fight for our lives. For me that means a Biden/Harris presidency and the fight to abolish & rebuild.
What awaits on the horizon is troubling and terrifying. The courts are working to impede us from building and fighting and so we will work that much harder to build and fight. I vote for the room to build. Then I never stop fighting.
