The current courts don’t even represent the legal profession — let alone America. The traditional path to a judgeship has involved a judicial clerkship, time in a prosecutor’s office (or running it), time at a corporate firm, or all three. The result is a biased system.
Most judges represented powerful institutions — be it the government or corporations — before being appointed to the bench. Disturbingly few judges represented the other side of those cases, the people challenging corporations or the gov’t or being prosecuted by the gov’t.
