The COVID-19 pandemic has exposed the weakness of our pandemic response regulatory framework. There is a patchy framework of regulation to address issues around sick people who refuse to isolate or exposed people who refuse to quarantine. 1/
Does the 4th amendment apply to pandemic testing - can governments mandate testing or not? Is testing at a state university a “search” by the government? When is it “unreasonable”? Do we want legislatures to establish the framework for this or judges? 2/
How can we have gotten this far into the pandemic and there are people involved in testing and public health who don’t know that people don’t test positive until 5-6 days after exposure? That people can transmit the disease days before they are likely to test positive? 3/end
