Earlier this year, a District Court ordered US Army Corps of Engineers to conduct an environmental impact statement on the portion of the Dakota Access Pipeline that crosses Lake Oahe, the 4th largest reservoir in the US.

Analysis developed through this EIS will help decide whether the DAPL crossing of Lake Oahe is authorized. (Court order nullified previous easement.)

Alternatives:

1 (No Action): Corps would not grant an easement and would require restoration of Corps-administered federal lands to pre-pipeline construction conditions.

2: Corps would not grant an easement and would take no further action.

Alternatives cont.

3: Corps would grant the requested easement with the same conditions as the vacated easement.

4: Corps would grant the requested easement with additional conditions beyond those in the vacated easement.
