Beard in Police force ??

The recent controversy being raked up by few regarding dismissal of UP Police sub-inspector for growing beard is not new and the only one. In past too there has numerous cases of dismissal and courts upheld the decision .

Most of these cops go to court quoting Armed forces examples . In Indian Army except Sikhs no one is permitted except on religious occasions for a temporary duration after exclusive permission from higher authorities.

Same is the case with Indian Airforce and Navy .

Constable Zahiroddin case 2012

He joined the State Reserve Police Force in Maharashtra in 2008. In May 2012, he was allowed to keep his beard. But in October, it was cancelled because the state government's rules changed.

Constable Zahiroddin asked the Bombay High Court to intervene but the court said that since he was a state government employee, the State guidelines would apply to him, over-ruling any permission or policy laid out by the Centre. He approached SC.

SC judge Justice Khehar said that the court shall allow him to keep a beard during the festivities. But, it was rejected by petitioner stating no provision of temporary beards in Islam and hence the CJI rejected his prayer.

Mohammed Fasi vs Superintendent Of Police And Ors. on 20 February, 1985

The petitioner entered Kerala Police as constable in 1963 and started keeping beard in 1983 which was denied .
He approached Kerala HC to quash the same .

Excerpts from counter affidavit filed

1. The petitioner has no case that dyeing the hair is farz (obligatory) according to Islam,and growing beard minus moustache is apparently sunnath (optional) and are not understood as obligatory for every Musalman to follow. ( Edit)

2. Such a practice is not in vogue. The President of a neighbouring Theocratic Islamic Republic does not wear a beard. Similarly high dignitaries like President, Vice President, Judges of the Supreme Court and High Court and Ministers have not been wearing beards.

3. Under Article 25(1) of the Constitution all persons are equally entitled to freedom of conscience and the right freely to profess, practise and propagate religion, subject to public order, morality and health and to the other provisions of Part III of the Constitution.

4. Clause (2) of Article 25 preserves the right of the State inter alia to make laws to provide for social welfare and reform and to regulate economic, financial, political or other secular activity associated with religious practice.

*My POV*

The Armed Forces and Police service is a voluntary organisation and anyone joining willingly is well aware of the dress code and ethics . There is no merit in creating ruckus over such issues post joining.
