Tonight four conservative Supreme Court justices indicated their support for a radical, anti-democratic theory that would stop state Supreme Courts from enforcing state election laws to protect the franchise. This was unthinkable just a few years ago. I expected the worst but I’m still stunned. Congressional Democrats need to understand that what happened tonight is terrifying. The Supreme Court is on the brink of undermining states’ ability to conduct free and fair elections. After Barrett’s confirmation, it could blow up the 2020 election. This is not a fucking drill.
We now know four conservative justices will embrace an extreme, frivolous theory to override state Supreme Courts and suppress the right to vote. The four hard-right conservative justices tried to suppress voting rights in THE MOST IMPORTANT SWING STATE with no plausible constitutional basis. Are they daring Democrats to expand the court? This is some nihilistic dystopian jurisprudence and Barrett is about to sign onto it.
