A short thread for NHS employers of EU folk from 1/1/21. You have a few that you need to get right to cover yourself.

You already have a legal duty to know the right to work status of all employees. EU staff get the same treatment as UK staff today, but not from 1/1/21.

Your job is simple until 31/12/20, you have to provide all your EU staff encouragement to apply for Settled status. You cannot require for proof of that status or application, but you must encourage them to apply. You can ask for voluntary disclosure.

From 1/1/21, it really isn't simple. Until our government gives us a guaranteed process, you must assume you have to treat all EU staff as if they were from another nation where we have no deal in place.

That's why it's so important that you help EU folk get it sorted now. You cannot leave it, or assume that they've done everything necessary.

It's really simple for you to get ahead of it now, why wait. Go and talk to your staff, see what help they need.
