If the 2017 tax law had included tossing the entire ACA, it almost certainly would not have complied with the Senate's rules allowing it to to pass with a simple majority, and Collins & McCain & Murkowski and maybe others would have voted no.

That said, Republicans could have stopped the lawsuit any time they wanted. The case isn't about constitutionality; a 1-line legislative fix would moot it.
The irony is Susan Collins only voted for the tax law when she got an agreement to vote on a follow-on bill *SHORING UP THE ACA.*

Does that make any sense if Congressional intent was really to flush the law?
