And I'm not trying to arbitrarily dunk on a dead woman here, nor do I think RBG acted maliciously. She was just wrong. She thought the existing system could be reformed to "include" and "recognize" women and minorities. And it can. But it can't be reformed to represent them.
When we focus on landmark cases like Brown v. Board of Education or Lawrence v. Texas, we overlook how most often the SCOTUS' function has been to protect elite interests from populist movements in Congress. It's very purpose is to undergird and stabilize our 1787 democracy.
But that means that *anybody* whose aim and ambition is to sit and adjudicate from the bench of this court is to do the same. My recommendation? Pack all the courts with activism-oriented lawyers who are critical of our legal system.
