...Biden is saying that using a power expressly given to the President is "not constitutional." You can disagree with the decision to use the power but to call it unconstitutional is bizarre...

...Either Biden believes that there is something in the Constitution barring election year nominations (which has occurred many times in history) or he is misrepresenting what is in the Constitution. Neither is comforting for a candidate for president.
