Around July 31st, Fisker had announced they will be rediscussing talks with Volkswagen at the beginning of September.

As you can see in this PR filing by $SPAQ. Hinrich Woebcken was retained in Apollo's management team.
$SPAQ Infact, the only reason Hinrich was appointed to Apollo's management team, was to get the deal done between Fisker & Volkswagen.
Hinrich even met with them at CES, most likely to see how viewers reacted to the car.
Only then, did merger talks start following in place.

However, let's say Volkswagen is not the case. @henrikfisker is no stranger in the auto industry. He has produced many cars before and it will not be hard for another OEM to make a deal.
But, see here, even on July 7th, Spartans board was confident Volkswagen is interested.

Now $SPAQ if we take a look at the above post, or the post below. Why would Spartan's Board indicate Volkswagen is still likely to close the deal.
In my opinion, if the VW deal doesn't happen, it's a choice by @henrikfisker to use a different better platform.
