In some states, poll watching is legal. Poll watching is NOT legal in MN. MN state election law allows a “challenger” – whose only action can be to contest the eligibility of another voter based on the challenger’s own personal knowledge of that voter’s ineligibility.
MN election law also states who may be in a polling place. The only people allowed in a polling place are voters, election judges & election officials, individuals assisting voters, or those conducting exit polling. Once a voter has voted, they cannot stay in the polling place.
There are specific requirements for challengers. A challenger can only be an election judge, an eligible voter from that same precinct, or an appointed challenger. Political parties/nonpartisan candidates can appoint one challenger per precinct to be in the polling place all day.
