If the FBI doesn& #39;t like you - if they want to force you to spy on your own community; if they want to brand you as dangerous; if they& #39;re suspicious of someone you know, or someone who knows someone you know - they might turn the screws by putting you on the No Fly List.

They did that to 4 Muslim men who refused to snoop on their own people.
For years, they were unable to make a living, or to visit ailing family members.
With @CUNY_CLEAR in October 2013, and then with @theCCR they sued the Feds to get off the list, and to be made whole.

In June 2015, right before argument in the case, the govt said the men were -magically!- no longer considered an aviation threat, and were allowed to fly.
The government hoped they would drop the case.
They didn& #39;t. They sought justice.

In September 2015, Judge Ronnie Abrams dismissed the case out of hand, ruling that FBI agents could punish people for exercising their beliefs, without any meaningful recompense.
The government again hoped the men would drop their case.

Almost a year later, in July 2016, the men appealed to the Second Circuit, arguing that agents should be held accountable for such egregious, coercive tactics.

In May 2018 (and again in February 2019!) judges on the Second Circuit Court of Appeals agreed.
They overturned the lower court, and said that - at the very least - these men should have their day in court.

As you may have guessed, government lawyers weren& #39;t happy about this.
They asked the Supreme Court to reconsider the Second Circuit& #39;s ruling and in November 2019, the Supreme Court agreed.

The case was slated for argument on March 24, 2020 before a 9 justice Supreme Court.
The pandemic hit. Argument was postponed.
Tomorrow, October 6 at 11 AM, Ramzi will be presenting the case before 8 justices.
