The Supreme Court has ruled that title to land can be confirmed if the title holders can show possession prior to the Royal Proclamation 1763 and continuous possession after. Haudenosaunee can so continuous occupation of Southern Ontario since that time.
Williams Treaty 1923 purported to have Mississauga surrender land in Southern Ontario to the Crown but Mississauga peoples were only here as a result of the 1656 One Spoon One Bowl treaty which saw them come from the north to hunt and reside in Haudenosaunee Territory.
Mississauga surrender has no force and effect since the signatories did not hold the land and were under Haudenosaunee protection - which exists today. That means that they still have rights to the land under our treaty and therefore could not have legally sold land.
So given all this we must add to the outstanding trust monies the use of Ontario (from the Ottawa River to Lake Nippissing south) and extraction of resources from lands never surrendered by us.
And now the government has attempted to give Algonquins of Ontario land that has never belonged to them. While I am told that Haudenosaunee Royanier still recognize the lines between Algonquin and Haudenosaunee territories (watersheds flowing north vs watersheds flowing south)
Neither Canada nor Ontario nor the Crown in general ever took legally (using British law in common) possession of Ontario lands. Any claim by any of them does not meet the test set out by the Supreme Court.
Therefore, we are owed in addition to the trusts, revenue from all resource harvesting and either loss of use for the land base for at least 153 years plus interests (the same as required for our Six Nations trust) or improved fair market value in today's economies....
IF we decide to surrender.
