@MafabiShaidu asked me to make a thread on passing LDC exams.
I don& #39;t think that there is something new I will add that you haven& #39;t already heard..but here are my few tips.1 https://twitter.com/MafabiShaidu/status/1311400489033097216">https://twitter.com/MafabiSha...

I don& #39;t think that there is something new I will add that you haven& #39;t already heard..but here are my few tips.1 https://twitter.com/MafabiShaidu/status/1311400489033097216">https://twitter.com/MafabiSha...
1. Preparation. LDC uses the socratic mode of teaching which is about problem solving rather than rote learning which is done in most LLB subjects. This method of teaching which is applied in the examination setting requires a high level of preparation
How to prepare..70% of ur success will depend on whether u have all the work covered in the year in ur book. This means that you must devote time and make sure that every learning outcome of the week is addressed in your book. LDC can ask about anything that was covered in a week
For example, in civil if u find that the remedy is to apply for leave to appeal out of time, if this work is in ur book, u will copy and paste the legal principles and conclude by applying the facts in the question. This will save u timev
But if u don& #39;t have this work, even if u know the remedy, u will spend more time figuring it how to start and in the end u will speak as a lay man.
So I must emphasise that go back to the first week of semester 1, check in ur book whether u have all the learning outcomes addressed whether they had been covered by the workshop or not.
If u don& #39;t have such work, immediately summarise the legal principles on that learning outcome. This will make u avoid surprises. Eg in my first exam of commercial I thought i had written in my book everything and didn& #39;t even carry the statutes,
I was shocked to find a question on foreign NGOs which wasn& #39;t in my book and I had not carried the ACT...that& #39;s why u have to have everything written in ur book.
2. Scope of the answer.
LDC is about application of legal principles but not about writing a research paper. So you must write down the legal principle, support it with a provision in the statute and apply case law. But remember one case is enough, preferably COA or Supreme Court

Don& #39;t be verbose. Hit the point, explain using the relevant legal authorities, conclude by advising your client. Don& #39;t forget to advise ur client.
3. Time.
The time given at LDC Will never be enough..u must allocate ur time to the questions depending on the marks. If drafting is 50marks, the question takes 2hrs, that means one hour must be for drafting. Most students spend much time writing essays forgetting the marks.

My trick was, I answer the first question, leave spaces, draft documents if they attract more marks than other questions, then come back to summarise answers to questions with low marks
But such a trick can cost u if u don& #39;t read the marks allocated well. Eg all our final term exams, had few marks for drafting..so u may spend more time perfecting drafting when actually it gives u like 10 marks. So plz allocate time according to marks.
4. Revising.
This depends on an individual..but u must know that 90% of all answers are in the statute. Learn how to read the statute..case law comes in when the statute is not clear

Eg for commercial law, 95% of the answers must be derived from the statutes. For commercial you must know that the Act and the regulations must be read together. The entire procedure is usually in the regulations.
In reading statutes, don& #39;t simply peruse and claim that u have read..there is one simple trick, Read the provision, write down the essential components of that provision and try to understand each of those elements, the ambiguous ones could have been interpreted by Court
Discussions. This is the last segment. Discussions are meaningful when all parties have read. Never go to the discussion merely to get knowledge from others. Go there to participate, read in advance, and help each other.
All in all, LDC requires u to invest more time in preparing by writing ur own notes in ur book. Any other theory of passing LDC depends on this. I end with the greatest advice from @bkabumba that at LDC, you MUST BUILD YOUR OWN FILE. Wish u success.
