So Schumer got the floor and managed to set up a cloture vote for Thursday on S.4653. It's titled "A bill to protect the healthcare of hundreds of millions of people of the United States & prevent efforts of the Department of Justice to advocate courts to strike down the (ACA)."
No. This is the full text of the bill:
"The Department of Justice may not in any case, including in California v. Texas.. advocate that a court invalidate any provision of the Patient Protection and Affordable Care Act or any amendment made by that Act."
WHAT??!?!
You get the floor, you can set up cloture, this never happens, and you... file a bill to say the DoJ really shouldn't file an amicus brief??
You had a chance to put R's in a SERIOUS bind, forced to vote AGAINST repealing the individual mandate to keep their repeal strategy alive!
Instead, this fairly dumb message bill purporting to tell DoJ what to do is easily flicked away.
Can anyone here play this game?
Just to be clear, if this bill managed to pass, and Donald Trump signed it...
It would not stop the case that could throw out the Affordable Care Act from being heard by the Supreme Court.
Even a sense of the Senate resolution for the ACA would be better than this.
