1/The day #Turkey’s constitutional court was due to examine his application regarding the legality of his ongoing pre-trial detention, an Istanbul heavy penal court is considering a new indictment, allegedly on ‘attempting to overthrow the constitutional order’ &espionage charges
2/ This is also the day when the @coe Committee of Ministers began its 3-day long meeting during which they will consider the implementation of the @ECHR_CEDH ruling in the Kavala case - the first Article 18 violation against Turkey, a very serious breach of human rights.
3/ The Constitutional Court postponed its decision, apparently citing the impending indictment and hey presto, the indictment was submitted, some of its details published in pro-government media. See the charges mentioned in tweet 1/.
4/ In the meantime, #OsmanKavala is approaching his third anniversary behind bars, his third birthday in prison (on Friday) and this, despite the emphatic @ECHR_CEDH ruling that concluded he must be freed... a decision that became final in May 2020.
5/ The European court concluded that his rights were violated and that there was no credible evidence against him to justify his continued imprisonment. The C of Ministers called for his immediate release pending the constitutional court decision in his case, only three weeks ago
6/ Every development in #OsmanKavala’s treatment confirms the European Court’s conclusion - that his treatment is motivated by an ‘ulterior purpose’, not one provided by law or justified by clear evidence of criminal wrongdoing doing.
7/ Turkey is bound by the @ECHR_CEDH decisions. The committee of ministers is the @coe body that ensures implementation. They must insist on implementation and issue a strong decision again this week. And #Turkey must #FreeOsmanKavala
