Prior to the actual conference starting, lots of chatter between a number of people about COVID, etc., and they appear to have no idea they can be heard!
We're told the Judge will be on shortly.

Everyone introduces themselves.
Judge is going to "encapsulate" the main arguments from both sides & will ask the lawyers if they agree. Then questions back & forth.
He's severely limiting the scope of this hearing to the topic of dismissal.
It's all about "does the Judge have the right to reject the dismissal request by the US Government".
My opinion: The Judge isn't happy. He sounds mildly pissed-off.
Judge just said Flynn didn't prove a Brady violation & that his lying was material.

Flynn obviously feels differently.
This is summing-up where we are now, not based on the filings made for this hearing.
Judge now wants to focus on Rule 48A. The right for the prosecution to dismiss or drop their case. He's saying he, the Judge, has a role in dismissals following indictment.
He's saying the prosecution MUST get his agreement on dismissal to make sure there is no inappropriate political pressure put on prosectors.
My sense is he's building a case to continue to oppose the dismissal of the guilty plea of Flynn. To even further drag this out - past Election Day.
Now he's suggesting he must consider "public interest", and he has the duty to, and must, prevent inappropriate prosecutorial discretion.
He's either going to continue to uphold the guilty plea or he's going a very long way to signal to Democrats & the Left that he's done everything he can to NOT allow the prosecution's request to dismiss. My sense: he's not going to allow the dismissal.
I hope I am wrong!
Now Judge turning to the "scope of the judiciary's discretion".

He seems to be continuing to build HIS case & ignore the prosecution's dismissal request.
He's mentioned, at least twice, that precedent states that the court is NOT required to "rubber stamp" a prosecution's motion to dismiss.
This is all coming from Gleeson's amicus brief(s).

Former U.S. district judge John Gleeson is a staunch Democrat & activist Judge.

He quit "the bench" in January 2016 as @realDonaldTrump came into office.
The Judge just used the phrase "this is the new normal" because people were not on mute and talking in the background of the call while he's still doing his "brief summary".

Opinion: I despise that phrase.
The Judge continues to build the "case" for NOT allowing dismissal. He's now moved on to @realDonaldTrump's tweeting. Seriously? Tweets?
The Judge is finally finished with his "brief summary" about 53 minutes after he started his "brief summary".
Government is now saying they have the discretion to dismiss, not the Judge.

Now, a technical issue, a bad echo. Requiring the Government lawyer to dial-in.

What a cluster!

They have no idea they need to shut off their speakers when they're speaking so they don't get feedback.

Now, a recess until 12:35 PM.

Someone needs to tell folks to shut off their speakers when they are off mute.
This is clearly an example of why we need less government!
The Judge was very gracious as he called for the recess, taking full responsibility for the technical issues & delay.
Just as the recess was about to begin, @SidneyPowell1 told the Judge she had numerous objections she wanted to get on the record.

I sense she's thinking she's going to have to appeal what the Judge decides today & wants the objections on the record to set that up.

Government lawyer is saying the Judge MUST dismiss.
Government saying Gleeson's examples are all of INDIVIDUAL prosecutors who were reckless. In this case the entire DOJ is behind the dismissal.
Government saying the Judge has NO POWER to get in the way of the dismissal.

NONE!
He's filleting & destroying Gleeson's brief(s).
A Senior DOJ lawyer just got on the call and is saying there isn't a case, he's angry the DOJ is being charged with being political, and is being very direct with the Court.

This is clearly a show of strength on the part of the DOJ. How committed they are to get this dismissed.
He's now referencing William Barnett's 302 where Barnett explains this was all a "get Trump" activity.

Also sharing that Comey said he couldn't say if Flynn lied of not.

They're blasting Gleeson & the Judge.
By blasting, I mean blasting Gleeson's & the Judge's positions & arguments.
If the Judge doesn't dismiss after this Senior DOJ lawyer gets done, he's clearly compromised or inept. The lawyer has eviscerated the Judge's & Gleeson's arguments.

Now the Judge is reading a letter to AG Barr from @SidneyPowell1.
Now the Judge is suggesting @SidneyPowell1 has breached ethics and he is questioning the propriety of her letter, sent before she officially entered an appearance in the Flynn case.

My opinion? He's looking to disparage and denigrate @SidneyPowell1.
He's also suggesting AG Barr acted inappropriately.

This is absolute garbage.

Now the Judge is asking for a copy of Barr's reply, and minutes of any meetings between @SidneyPowell1, the AG, and others at DOJ.
@SidneyPowell1 tried to jump in and the Judge shut her down.
@SidneyPowell1 is now speaking & she is one pissed off woman. Now going after @EricHolder. She is mad as a hornet right now.

The Judge just asked if she's spoken to @realDonaldTrump about this case.
She declined to answer, and he's pressing.

THIS IS FIREWORKS!!!

She just said she asked @realDonaldTrump to NOT ISSUE A PARDON.

He's grilling her on just how many times she's spoken to @realDonaldTrump, and when.
OK, this Judge is now trying to prosecute @SidneyPowell1.

IMHO, he's treading on VERY THIN ICE.

@SidneyPowell1 objects to Gleeson & all of his briefs, COMPLETELY.

It's "totally inappropriate" she says.

It's never happened before she says.

He's now starting to sound angry.

He's getting rattled.
She's now asking the Judge to step aside.

She's questioning his timing & motivations.

She is one pissed-off, Texan right now.
IMHO, this Judge is dirty. Very dirty.
"Your comments this morning show abject bias."

She once again asks him to step aside.

She keeps using the word "bias".

He's cutting her off, asking her to file a motion to recuse. She responded, "I'm writing it right now."
She tries to explain something, he cuts her off and tells her to file a motion.
Now she's pointing out all the "lies" in the Judge's "brief summary".

Everyone is making the Judge look like a jacka$$, which he is.

Now Gleeson ...
Gleeson butters-up the Judge & says the Judge was completely accurate in his "brief description".

He has nothing to add at this time.
I wonder how much Gleeson got paid for this?
The bias of this Judge is unmistakable & apparent to even the most unknowledgeable & disinterested observers.
A government lawyer just called Gleeson a "hired private prosecutor".
The government lawyers are VERY assertive about there being no precedent for what the Judge is doing here.

I wish every American could be listening to this.
Government now talking about the Conington attorneys making "false filings" to the Court.

The Judge just asked why no lawyer from the SCO - Special Counsel's Office - signed the letter to dismiss.

Has he been living under a rock?

What, 13 or 20 partisan, Democrat, hack, lawyers out to "get Trump"?
