Whatever one things of the source and upshot of the decay of norms of forbearance in judicial nominations I hope most can agree about the fundamental decency and brilliance of Amy Coney Barrett and treat her with the respect she deserves and realize that the current judicial
Equilibrium does not serve the national interest, that fundamental reform is required, that both “sides” have contributed to it and that working together with humility and consensus to set it rightly be a first step to rebuilding the comity we need to avoid a civil war.
As to what such reform would look like, a more modest and consensus version that I endorse is proposed by @dsallentess and her colleagues here: https://www.amacad.org/ourcommonpurpose/report">https://www.amacad.org/ourcommon... and
a more radical but ultimately more effectual/long-lasting version I proposed with Eric Posner: https://www.vox.com/the-big-idea/2018/6/4/17426004/travel-ban-cake-gay-rights-social-issues-judicial-activism-kennedy-democracy-qv">https://www.vox.com/the-big-i...
I hope friends ranging from @JohnnieM and @JuliusKrein through @willwilkinson and @SlaughterAM to @astradisastra and @kimmaicutler can come together to make change like this.
