There is so much wrong with Feldman’s piece that reflect so much wrong with the profession. Perhaps most egregious is the conclusion and the use of the “we” to make a point about the systems “we” choose. Not everyone has had such opportunity to choose into these structures.
And the people who have not chosen into this system—because they were not treated as human under the law, because their votes have been suppressed, because their lives have been assaulted, because they don’t teach at Harvard Law School—will suffer the most.
And it is cold comfort that Feldman thinks ACB is supremely intelligent. And truly something that he proclaims himself the decider of both what makes someone a great lawyer and what makes someone intelligent. The hubris is astounding and yet utterly typical.
