On court expansion, a couple of political thoughts.
1. We have to do it. There's not a single other recourse. And the signals from Biden and Schumer are clear enough. A wide swath of base from left to center will demand it. Win the Senate, expand the Court.
2. I'd make it part of full expansion, modernization, and reform of the Federal court system - and wrap it firmly in the ideals of fairness, ethics, and justice reform that so many stand behind. Make it landmark, backed by the basis of a strong democracy.
3. Phase the expansion in. First, neutralize the two seats the Republicans criminally stole - two new Justices before the mid-terms. Then phase in four more after each election cycle, so the voters get a say - let's have some voting on it! I suspect this would benefit Dems.
4. Most important is the ethical basis for expansion - this is *unpacking* the Court, and expanding it to better reflect the diversity and complexity of modern nation with 330M people. Tell the story, sell the story. GOP's moves are cynical - expansion and reform are idealistic.
