The crown is asking for 12-15 months jail time for Michael Theriault in the assault of Dafonte Miller. Defence lawyer Michael Lacy calls that "completely divorced from legal precedent"
The defence calls for a "fair and fit sentence." It gives options, including a suspended sentence, and says if the judge finds imprisonment absolutely necessary, it calls for a conditional sentence. That means it wouldn't be served in a jail.
The defence is now giving details beyond its written submissions, saying on the high end, imprisonment should be 90 days.
Defence lawyer Michael Lacy says the sentence will need to take into account that a police officer's time in custody is much different than it is for non police officers.
