The unanimous opinion is that Ta'dheer will be made i.e a punishment will be decided by the Judge according to his own discretion with that which is most conducive, as long as it does not exceed the severity of the Hadd of zina.
This thread was not articulated to point out the shar'ee regulation regarding homosexulaity, as that is clear in its import.
Rather it is a reminder for us to redirect our own behavior towards a group of people who sin differently.
Once again, in no way, do we condone the sin.
However, when it does come to Zina, there are two primary requisites for the establishment of the Hadd (penal punishment) viz;
self confession & the testimony of witnesses

The reasons behind this regulation are as follows;
1. It allows a person to confess to their evil deed in this world, thereby rendering the Hadd binding upon them & freeing them from the punishment of the hereafter if they were not to be forgiven & a means of clearing ones conscience. There is no obligation to confess.
Infact it is Mustahab (PREFERABLE), for the Imam to ENCOURAGE the confessor TO RETRACT HIS CONFESSION.
It is also a PRE REQUISITE for the person to confess 4 TIMES, to which the Imam will REJECT IT & only AFTER the 4th time in the 4th gathering, will he enquire about the details
2. If such an act is witnessed by FOUR individuals, clearly, as the insertion of one private part into another just as a kohl stick enters the bottle, then this is clear & utter immorality, as they have not only committed an indecent act but were unshameful by displaying it to
others which exposes, encourages & inclines others towards indecency as well, hence in this case Allah has prescribed the Hadd to eradicate such bold & open sin by means of which immorality can become widespread.
But here too, it is BETTER for the witnesses to CONCEAL, as it has been mentioned in Kitaabus Shahadaat

Hereunder are the Masaa'il pertaining to Zina
(which according to Ahnaaf do not apply to homosexulaity)
If you read through the entire chapter regarding Zina, you will come to understand how lenient they are in their literal implication.
• The laws of Shari'ah are a means of eliminating evil & creating a safe & moral environment not for the destruction of people & their honor.
Abu Hurayrah (ra) narrates; "On one occasion a man who had consumed alcohol (which is a major sin too, the nature of which Hadd becomes binding), was brought to Nabi ﷺ. He ﷺ said "beat him"
Abu Hurayrah (ra) narrates; "some of us beat him with our hands, others beat him with
their sandals & others beat him with their clothes." When the man turned & left, someone said; "May Allah disgrace you!" Nabi ﷺ said; "Do NOT say that, don't help shaytaan against him" (by making such a dua)
Bukhari
In another narration of Abu Hurayrah (ra), he said, Allahs messenger ﷺ said; "When a slave girl commits fornication & it is proven, she should be flogged & not rebuked. If she then commits fornication a second time, she should again be flogged & not rebuked,
if she then commits fornication a third time, he (the master) should sell her even if it be for a rope made of fibres.
Bukhari & Muslim
From these two incidents we can understand that whilst the prohibition was established, the Nabi of Allah ﷺ, in no way, dishonored & disgraced these individuals despite their acts of indeceny & transgression.
