KNOW YOUR RIGHTS PROTEST EDITION (NYC):

-Leave your phone & use a burner. If you can’t, disable data & location. Disable biometrics like face & finger unlock. Use a passcode

-Write the name of ur lawyer, a lawyer friend, or the NLG — NYC it’s 212 679-6018 — on your arm

-Tell your lawyer that they’re on call if they’re a person you know

-Go with a friend & stay together

-Make sure someone who is not protesting knows where you are

-Designate a trusted person to call the attorney number in the event you are arrested or can’t be located

-While protesting, do not share pictures or videos that could be used to ID others

-Record police if you can do so from a safe distance. It’s LEGAL if you’re not interfering. Share video/pics of abuse & arrests w the targeted person(s) &/or those they’re with

-Wear a mask

-Record names & badges of offending cops if possible

-Share know your rights info w others. Remind ppl being detained to stay silent. Share NLG # & call if you witness an arrest

-Photo ID *may* expedite your arrest processing, but you are NOT legally required to carry one

-If you’re stopped, ask “Am I free to go?” Cops will prob ignore you. But if they say “yes,” WALK AWAY. If they ignore you, you’re prob being detained. If they say no, congrats ur detained

-DON’T TALK TO COPS. Say: “I want my lawyer. I won’t speak w you.” Practice saying it

-If you’re non-US born, leave all immigration-related ppw/ID at home. @MaketheRoadAct has great info on protesting as an immigrant. It’s essential that you do not answer ANY questions, especially related to your country of birth. NYPD may contact ICE if you’re arrested.

-Understand that you are being watched by the surveillance state, including the Domain Awareness System and facial recognition software

-Understand that your DNA may be collected without your consent if you discard water bottles, cigarette butts, etc — in custody & not.

-NEVER consent to a search of your belongings, never unlock your phone for cops, & never consent to give DNA. Cops will make these things seem routine. Unequivocally say no.

-They may search you anyway. Leave valuables/stuff you don’t want cops to find & keep at home

-If arrested, it’s very unlikely you’ll get to call anyone. Attorneys like @gideonoliver & orgs like @LegalAidNYC have demanded the NYPD create a process for attys to locate arrested protestors/invoke rights & have gotten no response. You may disappear for a day or so.

-In custody, stay silent. Ask for your lawyer. Don’t accept food/drink/DNA vehicles if you are medically able

-Have someone call the NLG hotline if they don’t hear from you after an agreed upon time

-Have a plan in place for your kids/pets at home in case this happens.

-When you’re released, call your lawyer

-Preserve/ gather all info on your arrest — videos, pictures, witness info, write down cop names/badge before you forget, etc — it may be helpful for your defense & any civil claim

Understand that cops are not constrained by legality or what is right. Knowing your rights is a tool in a toolbox, not a bulletproof vest. Don’t talk to cops. Look out for each other & keep each other safe.
