Powerful and important piece. An example: the wording of clause 45 makes regulations under clause 43 that make a corrupt or biased grant, or otherwise illegal tax break, to a friend or relation of a government Minister or official immune from any challenge in court. https://twitter.com/ukcla/status/1308677492941582336
One of fatal flaws in @neill_bob’s supposed improvement to clause 45 is that it simply fails to deal with the catastrophic impact of clause 45 in rule of law terms on *domestic* law.
One can’t help wondering what @neill_bob would’ve said about a socialist government that put forward legislation that allowed it (even after a vote in the HoC) to give grants or tax breaks to whoever it liked with no ability of anyone to challenge the lawfulness of those grants.
(His clause doesn’t solve the international law problem either, but that’s a different story.)
