There's a lot of proposals floating around out there on how to avoid the effective death of the Supreme Court within the next 10-20 years. Here's my suggestion: 1/
Democrats add two justices, recognizing that either Gorsuch or Barrett/Lagoa was legit. One of those justices will be Merrick Garland, and we're roughly at status quo ante. 2/
We agree to constitutionally set the number of justices at 11, absent a 2/3 vote to raise the cap or unanimous consent. The same amendment gives any individual senator the power to call up a presidential judicial or executive appointment within 60 days of nomination. 3/
It obviously isn't perfect -- you can still serially vote down a president's nominees -- but at a certain point that's democracy. 4/4
