I reported yesterday how a Dalit organisation fought & won a legal case against a woman who was born Dalit, married a Muslim and fought Zila Panchayat poll on an SC-reserved seat in 2015.
She has now been suspended and FIR filed against her.
A few points from the legal case:
Initially, she told the Uttarakhand high court that the claim that she is legally wedded wife of Moazzam is without any basis.

HC directed U’khand caste scrutiny committee to check her caste status.
She told the committee that when she married Moazzam in 1997, it was as per Hindu rites at home & they didn’t register their marriage then. She said she has done it now, in 2019, and submitted the document
But committee found that she had admitted to having converted to Islam in a 2016 affidavit.
Note that her caste certificate names her as Kavita w/o Moazzam, but all other documents in all these years like voter card and ration card name her as Ashiya)
Committee also said that as she had got permanent resident certificate of Uttarakhand based on her marriage with Moazzam, she could not claim to be SC anymore. Committee said Haridwar tehsildar should not have given her SC certificate in the first place (which she got in 2011)
Another imp point was this: even if she was still SC, caste benefits are state-specific. She, born in Delhi, could not avail of SC benefits in Uttarakhand and hence was not qualified to fight on SC-reserved seat in Haridwar.
